TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of services provided by Discover Opportunities, operated by Caroline McGrath ("we," "us," "our"). By booking or participating in our coaching services, you ("Client," "you") agree to these Terms.

1. SERVICES PROVIDED

We provide transformational coaching services including:

  • Individual 1:1 coaching sessions
  • Group workshops (Foundational Workshops)
  • Team coaching sessions for organizations

All services utilize the D.O. Method™, a proprietary coaching methodology focused on identifying and shifting patterns through values, beliefs, and behaviour awareness.

2. NATURE OF COACHING

2.1 Coaching is Not Therapy Our services are professional coaching, not psychotherapy, mental health treatment, or medical advice. Coaching focuses on goal achievement, personal development, and professional growth.

2.2 Not a Substitute for Professional Services Coaching does not replace the need for therapy, counseling, medical treatment, legal advice, or financial planning. If you require these services, we recommend seeking appropriate licensed professionals.

2.3 Client Responsibility You are responsible for your own decisions, actions, and results. We provide guidance and support, but you maintain full autonomy over your choices.

3. BOOKING AND SCHEDULING

3.1 Discovery Calls Initial 20-minute discovery calls are complimentary and do not obligate either party to engage in paid services.

3.2 Session Booking

  • Sessions are booked by mutual agreement
  • You will receive confirmation of scheduled sessions via email
  • Sessions are typically 60-90 minutes for 1:1 coaching

3.3 Cancellation and Rescheduling

  • 48-hour notice required for cancellations or rescheduling
  • Cancellations with less than 48 hours' notice will forfeit the session
  • Emergency exceptions may be considered at our discretion
  • No-shows forfeit the full session fee

3.4 Coach Cancellation If we need to cancel or reschedule, we will provide as much notice as possible and work with you to find an alternative time.

4. PAYMENT TERMS

4.1 Payment

  • Payment is required at the time of booking unless otherwise agreed
  • We accept payment via [your payment methods]
  • Invoices are provided for organizational clients

4.2 Pricing

  • Current pricing is available on our website or upon request
  • Prices are subject to change with reasonable notice
  • Agreed pricing is locked in for prepaid packages

4.3 Refunds

  • Unused sessions from prepaid packages may be refunded within [30/60/90] days of purchase
  • No refunds for completed sessions
  • No refunds for sessions forfeited due to late cancellation or no-show
  • Workshop fees are non-refundable within 7 days of the event

4.4 Late Payment Failure to pay on time may result in suspension of services until payment is received.

5. CLIENT RESPONSIBILITIES

You agree to:

  • Arrive on time for scheduled sessions
  • Participate honestly and openly
  • Complete any agreed-upon reflections or exercises between sessions (if applicable)
  • Inform us of any changes in circumstances that may affect coaching
  • Not record sessions without explicit written permission
  • Respect our time and professional boundaries

6. CONFIDENTIALITY

6.1 Our Commitment We maintain strict confidentiality regarding all information shared during coaching sessions, except as required by law or in cases involving:

  • Risk of harm to yourself or others
  • Child abuse or neglect
  • Legal requirements (court order, subpoena)

6.2 Organizational Coaching When coaching is sponsored by an organization:

  • Progress updates may be shared with the sponsoring organization as agreed
  • Specific session content remains confidential unless you provide written consent
  • Aggregate data may be shared for evaluation purposes

6.3 Your Confidentiality You agree to keep proprietary coaching materials, tools, and methodologies confidential.

7. INTELLECTUAL PROPERTY

7.1 Ownership The D.O. Method™, all coaching materials, worksheets, frameworks, and content provided during coaching are the intellectual property of Discover Opportunities and are protected by copyright.

7.2 Limited License You receive a personal, non-transferable license to use materials provided for your own development only. You may not:

  • Share, distribute, or resell our materials
  • Use our methodologies for commercial purposes
  • Reproduce or modify our copyrighted content

7.3 Testimonials We may request your permission to use anonymized testimonials or success stories for marketing purposes. Your permission is optional and can be revoked at any time.

8. LIMITATIONS AND DISCLAIMERS

8.1 No Guaranteed Results While we are committed to providing high-quality coaching, we cannot guarantee specific outcomes. Your results depend on many factors including your engagement, effort, and individual circumstances.

8.2 Limitation of Liability To the fullest extent permitted by law, Discover Opportunities and Caroline McGrath are not liable for any indirect, incidental, or consequential damages arising from coaching services.

8.3 Maximum Liability Our total liability for any claims related to our services shall not exceed the amount you paid for the specific service in question.

9. TERMINATION

9.1 Client Termination You may terminate the coaching relationship at any time with written notice. Refunds for unused prepaid sessions will be processed according to Section 4.3.

9.2 Coach Termination We reserve the right to terminate the coaching relationship if:

  • Payment terms are not met
  • You behave in a manner that is disrespectful, threatening, or inappropriate
  • We determine we are not the right fit for your needs
  • Continuation would violate our professional ethics

In such cases, you will receive a refund for unused prepaid sessions.

10. PROFESSIONAL STANDARDS

We adhere to the ethical standards of:

  • International Coaching Federation (ICF)
  • European Mentoring and Coaching Council (EMCC)

11. DATA PROTECTION AND PRIVACY

Your personal information is handled in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). Please review our Privacy Policy at [link].

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance of the new Terms.

13. GOVERNING LAW

These Terms are governed by the laws of Ireland. Any disputes will be resolved in the courts of Ireland.

14. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy and any signed Coaching Agreement, constitute the entire agreement between you and Discover Opportunities.
